1.    Liability for Content

1.1    PROMIS@Service makes every effort to keep the information on its websites and portal current. Yet, its responsibility as a service provider is limited to its own content on these websites and portal. PROMIS@Service especially accepts no liability whatsoever for content provided by third parties, e.g. Consultants qualified for PROMIS.

1.2    Without limitation PROMIS@Service will not be liable whatsoever for any damages of any kind including direct, indirect, incidental, punitive, special and consequential damages arising out of or in connection with the use of any of its services, the inability to use the services, including those resulting from any services obtained by third parties, e.g. Consultants qualified for PROMIS.

1.3    PROMIS@Service is not obligated to monitor third party information provided or stored on its website. However, PROMIS@Service shall promptly remove any content upon becoming aware that it violates the law. Our liability in such an instance shall commence at the time we become aware of the respective violation.

2.    Liabilty for Links

2.1    The PROMIS websites and portal contain links to third-party websites. PROMIS@Service has no influence whatsoever on the information on these websites and accepts no guaranty for its correctness. The content of such third-party websites is to the full responsibility of the respective owners/providers.

2.2    PROMIS@Service  strictly distances itself from all content of all external websites linked with the PROMIS websites which are conflicting with any applicable law and does not take any responsibility for such illegitimate content.

3.    Copyrights

The content and works provided on these websites and portal, such as texts, graphics and pictures, are governed by the copyright laws of the country of Customer. Duplication, processing, distribution, or any form of commercialization of such material beyond the scope of the copyright law shall require the prior written consent of its respective author or creator.

4.    Data Protection

4.1    PROMIS@Service undertake all reasonable efforts to protect the data of Users of the PROMIS services from unauthorized access by third parties in connection with such use. There are, however, inherent security risks in transmitting data via the Internet, because it is impossible to safeguard completely against unauthorized access by third parties. Consequently PROMIS@Service shall not be held liable for any damages incurred as a result of such security risk.

4.2    PROMIS@Service opposes the use of any available contact information by a third party for sending unsolicited advertisements. As the provider of the websites and portal, PROMIS@Service reserves the express right to take legal action against unsolicited mailing or e-mailing of spam and other similar advertising materials.
